Acsiryo Terms and Conditions
Introduction and Acceptance of Terms
By using the Acsiryo platform (the “Service”), you (“User”) agree to these Terms and Conditions. The Service is provided by Acsiryo and is governed by applicable laws, including Japan’s Act on the Protection of Personal Information (APPI). If you do not agree to these Terms, do not use the Service. These Terms, together with our Privacy Policy, form a binding agreement that you must accept (for example, by checking a box) before onboarding.
Description of Services
Acsiryo is a web-based platform connecting patients and doctors for clinical coordination and follow-up (e.g., scheduling appointments and conducting care follow-ups). It is not a regulated medical device and does not provide medical diagnosis or treatment. The information on the platform is provided to support care coordination and is not intended as medical advice. Always consult qualified healthcare professionals for medical concerns.
User Responsibilities
- Account Use: You must register as a Patient or a Doctor and may only have one account. Do not impersonate others or use another person’s account.
- Accuracy: Patients must provide truthful and accurate information when requested. Doctors must ensure their professional information (such as qualifications and specialization) is accurate.
- Compliance: You must comply with all applicable laws and with Acsiryo’s instructions. Doctors should follow professional regulations; patients should follow medical care instructions.
- Conduct: Use the Service only for its intended purposes. Do not misuse the Service (for example, by spamming, harassing others, or accessing unauthorized data). Treat all communications and data as confidential in accordance with these Terms.
Security and Login Credentials
You are responsible for keeping your account ID and password confidential. Do not share your login credentials with others. Promptly notify Acsiryo if you suspect any unauthorized use of your account. Acsiryo implements reasonable security measures to protect data, but cannot be held liable for unauthorized access caused by your failure to secure your account.
Personal Data Collected
To provide the Service, Acsiryo collects certain personal information from Users. The categories of personal data include:
- Patients: Name, address, birth date, sex, family medical history, current symptoms or condition, email address, phone number, employment status, and a password.
- Doctors: Name, email address, medical specialization, clinic or hospital affiliation, and a password.
Some of the patient data (such as medical history and symptoms) is considered “sensitive personal information” under APPI. Acsiryo will obtain explicit consent before collecting or processing such sensitive data.
Purposes of Data Use
We collect and use personal data only for the purposes specified in these Terms and our Privacy Policy. These purposes include:
- Providing the Service: Managing user accounts and enabling the core functionality of the platform (linking patients with doctors, messaging, scheduling, and follow-up tasks).
- Clinical Coordination: Allowing doctors and clinics to access or update patient information needed for ongoing care.
- Communication: Notifying you about appointments, medical follow-ups, Service updates, or relevant health information.
- Service Improvement: Analyzing usage patterns to improve and develop the platform’s features and user experience.
All use of personal data is limited to what is necessary for these purposes. We will not use your data for unrelated purposes without obtaining additional consent.
Data Handling and Protection (APPI Compliance)
Acsiryo complies with APPI requirements in handling your personal data. In particular:
- Purpose Specification: We clearly specify and communicate our purposes for data use, as required by APPI Article 17.
- Use Limitation: We use your data only to the extent necessary to fulfill the specified purposes.
- Accuracy and Retention: We keep personal data accurate and up-to-date, and we delete it when it is no longer needed for those purposes. Retention periods may depend on account activity, legal obligations, or clinical recordkeeping standards.
- Security Measures: We implement appropriate technical and organizational security measures to prevent data leakage, loss or damage.
- Employee and Vendor Supervision: We require our employees and any subcontractors to handle personal data under strict confidentiality. We exercise adequate supervision over anyone we entrust with data processing, in accordance with APPI Articles 24–25.
- Breach Reporting: In the event of a data breach that could harm your rights, we will report it to the Personal Information Protection Commission and notify affected users promptly as required by APPI.
Data Sharing with Clinics and Authorized Parties
- Acsiryo may share your personal data with trusted healthcare providers, laboratories, or IT service providers strictly for the purposes of delivering clinical services and operating the Platform.
- These partners process data under Acsiryo’s instruction and are required to comply with Japanese data protection law (APPI).
- If we coordinate your care through a new clinic or provider, we or the clinic may notify you or obtain consent, depending on the situation and applicable rules.
- We do not sell your data. Data will never be shared with advertisers or unrelated third parties.
- In rare cases, disclosure may be required by law or regulation.
Limitations of Liability
Acsiryo is provided “as is” with no warranty. To the maximum extent permitted by law, Acsiryo and its officers, employees and agents will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Service. In particular:
- The Service is not medical advice or a medical device. It is intended only to support care coordination. Always follow the guidance of qualified healthcare professionals.
- We do not guarantee that the Service will be uninterrupted, error-free, or free of bugs or malware. We are not responsible for any losses or damages caused by technical issues, internet connectivity problems, or actions of third parties.
- We are not responsible for the accuracy of information entered by users (patients or doctors). Each user is responsible for verifying that the personal or medical information they provide is correct.
- Any decisions you make based on the Service’s output are your responsibility. We specifically disclaim liability for any health outcomes or other consequences arising from use of the platform.
Consent and Revocation of Access
By accepting these Terms, you consent to Acsiryo’s collection, use and sharing of your personal data as described above. You may withdraw your consent at any time by contacting us or by terminating your use of the Service. (Withdrawal of consent may limit or prevent access to Acsiryo, as the Service depends on certain data to function.) You have the following rights under APPI:
- Access and Correction: You may request disclosure of the personal data we hold about you and ask that any inaccuracies be corrected.
- Deletion: If personal data we hold is being handled in violation of APPI (for example, beyond the agreed purpose), you may request that we stop using or delete that data.
To exercise these rights or revoke consent, contact Acsiryo at our support email or phone. We will handle your request promptly in accordance with APPI.
